Misuse of Law by Minister and his family
We request you all to help in all possible ways in ending the extreme torture, humiliation and harassment of our whole family which is being given directly and indirectly by the Union Minister of State for Food Processing Industries Mr. Subodh Kant Sahay and his treacherous relatives.
After the death of my mother due to prolonged chronic lung diseases and under conspiracy to get custody of my sister and myself, my father was arrested under pressure for murder for dowry (after 12 years of very happy and completely complain free married life).
Then police suppressed and concealed most important records including hospitalisation records, cause of death etc. and other evidences/papers to chargesheet my innocent father. My Baba and Dadi were also accused of same false charges but since they were not arrested so after later detailed investigation under Senior S.P. Ranchi they were given final report after all charges were found false subsequent to my father's false chargesheet.
Then before bail of my father Hon'ble Supreme Court also called for CID reports which also proved this case false.
Then after coming out on bail my father asked for ornaments of my mother from wife of younger brother of Mr. Subodh Kant Sahay who refused so my father did Complain case no. 45/2006 in Ranchi in which she is now on bail.
My father was threatened many times to withdraw this case and give us (my sister and me) to the relatives of Mr. Subodh Kant Sahay.
After that my father was transferred against rules to Assam suddenly from Central Coalfields Limited to North Eastern Coalfields. Under RTI my Baba (Mr. K.P. Verma) and Dadi (Mrs. Saroj Bala) asked for reason of transfer to Assam and the truth came out. Ministry of Coal informed that Subodh Kant Sahay Minister for Food Processing Industries and M.P. of Ranchi wanted my father Hitesh Varma transfered to Assam in NEC.

We all wrote to P.M. who set up inquiry. Police inquiry as also inquiry by C.I.D. Jharkhand proved that my father had been falsely implicated in the case after natural death of our mother Late Sanajana Verma and that the relatives of Subodh Kant Sahay were unneccessarily harassing my father.
My father filed two case in Hon'ble High Court, Ranchi for CBI inquiry into the false case on him as also for quashing of his malafide transfer.
Being afraid of press reports (coming out regularly in news papers and TV also like IBN7 etc) Mr. Subodh Kant Sahay and his bad lying relatives again filed another false case in Kolkata by enacting a kidnapping drama. On 25-5-2007 after midnight police suddenly came to our house and forcefully took my father to jail in Kolkata. We all went to Kolkata and showed all the papers etc. to S.P., S.D.P.O. Inspector there. Police has now filed final report no. 127 of 2007 dated 22-9-2007 that the boy (my mother's elder sister's son) had never been kidnapped and this Rajarhat PS case no. 247/07 is also false (“Mistake of Fact”). But my innocent father was in jail for 21 days in Kolkata for no fault and had almost died in Court itself but Doctors of Kolkata and Police's timely action saved his life.
Mr. Subodh Kant Sahay wants to get my father murdered in Assam so even after Hon'ble Court's Order dated 30-8-2007 in W.P. (S) 2389/07 he has not been allowed to join in CCL Ranchi. His bosses were afraid of Mr. Subodh Kant Sahay.
But the double bench of Hon'ble High Court of Jharkhand including the Hon'ble Chief Justice strongly directed his office and with GOD's grace he has joined his earlier post and our life back to normal. His transfer order has also been cancelled by Coal India Limited.
The court has also not framed charges against my father till date and his petition for discharge is being heard for calling for the initially concealed hospital records etc. which have now come on record through supplementary investigations as also 2 CID inquiries and 1 police inquiry. In the case done by my father for CBI inquiry the Hon'ble Jharkhand High Court had called for the investigation reports and the CID inquiry reports and subsequently dissallowed CBI inquiry on the ground that all evidences prooving the innocense of my father have already come on record which my father can use in the Trial Court so again inquiry by CBI is not required.
We request you all to atleast PRAY TO GOD so that the truth prevails at the earliest please...

Verma and all other relatives of Mr. Subodh Kant Sahay were present since 12-10-2004 when we took my mother to Hospital, my mother died on 13-10-2004 night where these people were also present. After my mother's death for two days my father was crying and they were consoling him. But only after two days false case of torture and murder for dowry was done under conspiracy when Mr. Subodh Kant Sahay and my elder mama (mother's brother) Mr. Niraj Kumar came from USA. They are very bad people, they tell only lies.

Union Minister pressurized for illegal transfer RTI saves the CCL officer, HC notice to Minister Subhodh Kant Sahay

Once again an historical victory for the Right to Information Act (RTI). Earlier, it was impossible to check misuse of power by VIPs.
But the RTI has made it very simple. You can expose any misuse of power by paying merely ten rupees.
In Ranchi, Jharkhand, Union Minister of State, Food and Processing, Subodh Kant Sahay, had misused his power to get a CCL officer transferred. This has been exposed through the RTI. Based on the information, Jharkhand High Court has stayed the transfer. The court has also issued notice to the Minister Sahay to explain his role in this illegal manner of transfer.
Hitesh Verma is an Executive in E-IV grade in a public sector company Coal India Limited (CIL). He was posted in its subsidiary company CCL (Central Coalfields Limited) at Ranchi as Deputy Sales Manager. In October 2006, he was transferred to NEC, Assam. He was well aware that the Union Minister has misused his power to harass him.
But thanks to RTI, his mother Smt Saroj Bala Verma, Reader, Ranchi Womens' College, filed an application for seeking 22 points reply related to the transfer. She demanded to have provided the latest transfer policy of Coal India. She also sought information on why and on whose insistence her son was transferred. She also asked whether any other officer working in her son's grade had also been transferred to NEC, Margheritta , Assam from CCL or any other subsidiary of CIL or vice versa since the transfer policy was made effective in CIL. In its reply, Coal India admitted that the transfer was based on reference from a VIP. The reply also furnished information that the transfer policy was effective since 1.4.2002 and since then no other officer in Hitesh's grade had ever been transferred to NEC from other subsidiaries of CIL or vice versa except her son Hitesh Varma. But Coal India was silent on the name of the VIP.
The Mother sent a letter to the PM requesting to provide the name of the VIP. The PMO ordered the ministry of coal to provide the requisite information. Ultimately, the Ministry of Coal disclosed the name of the VIP as Union Minister of State for Food Processing Industries - Subodh Kant Sahay.
It was also revealed that the reference was transferring Hitesh specifically to NEC, Assam.
There was no reason for seeking this transfer and the Coal India had no administrative ground for such action. It was clear that the minister had wanted Verma transferred because of personal reasons. It was further clear that the transfer order violates CIL rules. The information had also clearly revealed that CIL had not transferred any of its officers in E4 grade, to which he belongs, to the Assam or vice-versa in the past five years.
Therefore, the transfer of Hitesh Verma was malafide.
Based on this information, Hihesh Verma moved to Jharkhand High Court.
The Court of Justice RK Merathia passed the order on August 30, 2007 to stay the transfer order and to withdraw the relieving order.
The court also issued a notice to the Minister for Food Processing, Subodh Kant Sahay, seeking an explanation over the transfer.
Why did the minister misuse his power?
This is a tragic family drama like story.
Mr. Sahay is a Member of Parliament from Ranchi. His niece Sanjana was married with the officer, Hitesh Verma in 1993. They enjoyed a happily married life for 12 years, had two lovely and intelligent children, Avaneesh (aged 12) and Aishani (aged 6). But a sad incident collapsed everything. Due to illness, Sanjana died on October 13, 2004 in spite of the best possible treatment (due to `Interstitial Lung Disease' and `Pnuemonia' – incidentally due to which the Bihar CM has sadly recently lost his wife too). But Hitesh's sorrows were far from over. His in-laws lodged a case of torture for dowry (after 12 years) and MURDER! He was put behind bars from October 2004 to December 2005. He was also suspended from CCL during his jail period. After getting bail, he also got his suspension revoked and he rejoined service. But in October 2006, he was transferred to Assam due to the Minister's pressure.
Thanks to RTI, Hitesh Varma has found his feet back and is a fan of the Right To Information Act.
